 A fresh trial is the solution, according to Judge Jenny Rivera, who referred to the mistakes as “egregious.” If prosecutors choose to go forward with a second trial, Weinstein’s accusers might be called to testify once more.

In a dissenting decision, Judge Madeline Singas criticized the majority of omitting to acknowledge that the jury was permitted to take Weinstein’s prior assaults into account and for “whitewashing the evidence to make them correspond to a he-said/she-said narrative.”

Godbold, an ex-commercial production employee who claims Weinstein assaulted her twice in 1991, told NBC News that her initial response to the decision was “a visceral one.”

Actor Caitlin Dulany, who has claimed that Weinstein molested her in a hotel room during the 1996 Cannes Film Festival, expressed her amazement and sadness.

The verdict, according to Filipina-Italian model Ambra Battilana Gutierrez, who accused Weinstein of groping her and recorded him declaring, “I won’t do it again,” exposed continued shortcomings in the legal system.

Godbold said she hopes the New York accusers remember that “our truth isn’t overturned, even if his conviction is overturned.”

After being found guilty of two crimes in 2013—rape in the third degree for attacking an aspiring actor and criminal sex act for forcing a TV and film studio assistant to have oral sex in 2006—Weinstein, 72, has been incarcerated in New York for 23 years.

His history of sexual misconduct and his disregard for responsibility fueled the #MeToo movement.

Weinstein was also charged in Los Angeles. In 2022, he was found guilty of rape there and given a 16-year jail sentence. In that instance, he was cleared of all charges of sexual battery.
